02Nature of Our Service
Innovator Pathway provides professional business plan writing and advisory documentation exclusively. We are not immigration lawyers, immigration advisers, solicitors, or legal consultants. We are not authorised or regulated to provide immigration advice under the Immigration and Asylum Act 1999 or any other UK legislation. Providing immigration advice in the United Kingdom without authorisation from the Office of the Immigration Services Commissioner (OISC) or regulation by the Solicitors Regulation Authority (SRA) is a criminal offence. Innovator Pathway does not provide such advice and does not purport to do so.
Nothing contained in our website, our business plans, our consultations, our emails, or any other communication from Innovator Pathway constitutes immigration advice, legal advice, or a guarantee or prediction of any visa or endorsement outcome.
03Fees and Payment
All fees are confirmed in writing before work begins. Fees are payable in advance of work commencing, or in agreed instalments as specified in the client engagement letter. The commencement of work is defined as the point at which Innovator Pathway begins research, drafting, or any preparatory work in connection with your instruction.
04Non-Refundable Fees
All fees paid to Innovator Pathway are non-refundable once work has commenced. Our fees are charged for the professional time, expertise, research, and effort invested in preparing your business plan documentation, not for any particular outcome. If your endorsing body declines to endorse your business, or the Home Office refuses your visa application, our fees are not refundable. Endorsement and visa decisions are made by independent third parties over whom Innovator Pathway has no control or influence. By engaging Innovator Pathway and making payment, you confirm that you have read, understood, and accepted this policy.
05No Guarantee of Outcome
Innovator Pathway does not guarantee, promise, or imply any particular outcome in respect of endorsement applications, visa applications, or any other third-party decision. Any statement on our website, in our marketing materials, in our consultations, or in any other communication that refers to success rates, approval rates, or client outcomes is provided for general informational purposes only and does not constitute a guarantee or warranty in respect of any individual application. The endorsement process and the UK visa application process involve multiple independent decision-making stages, each governed by the policies, criteria, and discretion of the relevant authority, over which we have no influence.
06No Liability for Third-Party Decisions
Innovator Pathway accepts no liability, financial or otherwise, for decisions made by endorsing bodies, the Home Office, UK Visas and Immigration, or any other third-party authority in connection with any endorsement application or visa application prepared using Innovator Pathway documentation.
07Client Responsibilities
The client is responsible for:
- Providing accurate and complete information to Innovator Pathway.
- Instructing a qualified UK immigration lawyer or OISC-regulated adviser for immigration advice and visa application submission.
- Ensuring compliance with all Home Office requirements and deadlines.
- Verifying the accuracy of all information contained in the documentation we prepare before it is submitted.
08Your Confirmation
By engaging Innovator Pathway and making payment for our services, you confirm that you have read and accepted the following:
- Innovator Pathway is a business plan writing service only and is not an immigration lawyer, immigration adviser, or solicitor.
- Innovator Pathway does not provide immigration advice or legal advice of any kind.
- All fees paid to Innovator Pathway are for the preparation of written documentation only and are non-refundable under all circumstances.
- The non-refundable fee policy applies regardless of whether your endorsing body endorses your business or the Home Office approves your visa application.
- Innovator Pathway does not submit visa applications to the Home Office, and you must instruct a qualified UK immigration lawyer or OISC-regulated adviser for this purpose.
- Innovator Pathway cannot guarantee any outcome in relation to endorsement or visa applications.
- You are engaging Innovator Pathway solely for the purpose of obtaining professionally written business plan documentation.
- You have sought, or will seek, independent immigration legal advice before submitting your visa application to the Home Office.
09Accuracy of Information
Innovator Pathway prepares documentation based on the information you provide. You are responsible for the accuracy and completeness of all information supplied. Innovator Pathway accepts no liability for inaccuracies arising from incorrect or incomplete information provided by you.
10Revisions and Scope
Each package includes the number of revision rounds specified for that service. Work that falls outside the agreed scope will be quoted and agreed separately before it is undertaken.
11Intellectual Property
On receipt of full payment, you own the final documentation we deliver for your own use in connection with your application. We retain ownership of our underlying templates, methodologies, and know-how.
12Confidentiality
Innovator Pathway treats all client information as strictly confidential and in compliance with UK GDPR and the Data Protection Act 2018. A Non-Disclosure Agreement is available upon request prior to the disclosure of any client information.
13Limitation of Liability
To the fullest extent permitted by law, our total liability to you in connection with our services is limited to the total fees paid by you for those services. We are not liable for any indirect or consequential loss. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law.
14Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15Changes to These Terms
We may update these terms from time to time. The version published on this page with the revision date shown applies to your engagement.
